As defined in Section 704 of Public Law 117-263, a circumstance in which, under the criteria set forth in Paragraph 3.1.b. of DoDI 6490.08, the need to prevent serious harm to an individual or essential military function clearly outweighs the need for confidentiality of information obtained by a health care provider incident to mental health care services voluntarily sought by a member of the military services.
